AMENDMENT TO HOUSE BILL 3274

2    AMENDMENT NO. ______. Amend House Bill 3274 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Fair Act is amended by changing
5Sections 6 and 10 as follows:
 
6    (20 ILCS 210/6)  (from Ch. 127, par. 1706)
7    Sec. 6. Policies, procedures, and powers concerning the
8operation of fairs.
9    (a) Policies. The Department shall, pursuant to the
10Illinois Administrative Procedure Act, establish by rule:
11        (1) the policy for the operation of the Illinois State
12    Fair and the DuQuoin State Fair, except those operations
13    regarding contests as provided for in subparagraphs (b) and
14    (c) of this Section, and
15        (2) the policies and procedures for the sale, barter,
16    or exchange of tickets and for ticket refunds for cancelled

1    events.
2    (b) Contests. The Department shall establish and make
3available, for all contestants and other interested persons,
4sufficient copies of a premium book or other publication that
5establishes the kinds and classes of events or exhibits for
6contests at the fairs, the conditions under which contestants
7shall be entered into contests, the qualification and
8disqualification requirements of contests, the drug testing
9requirements for contests (if applicable), the premiums to be
10offered to contest winners, the manner in which certificates of
11award shall be distributed and premiums paid to contest
12winners, the penalty for violations of a rule, condition,
13instruction, or directive, and requirements of contests,
14including but not limited to the return of all premiums paid,
15the forfeiture of awards, and the prohibition of participating
16in future contests, and all other rules and requirements for
17contests. These rules, conditions, instructions, directives,
18and requirements shall be exempt from the rulemaking procedures
19of the Illinois Administrative Procedure Act. All such
20publications issued by the Department that relate to a contest,
21event, or exhibit shall be maintained as a public record at the
22Department's principal office in Springfield, Illinois, and
23made available for public inspection and copying during regular
24business hours.
25    (c) Fees. The Department shall establish and publish for
26the Illinois State Fair and the DuQuoin State Fair a schedule

1of admission fees, entry fees, concession fees, space rentals
2and other fees for activities offered or provided at each State
3Fair. These schedules of fees shall be maintained as a public
4record at the Department's principal office in Springfield,
5Illinois, and made available for public inspection and copying
6during regular business, but shall be exempt from the
7rulemaking procedures of the Illinois Administrative Procedure
8Act.
9    (d) Facilities. The Department may negotiate and enter into
10contracts for activities and use of facilities for which there
11is not an established or published schedule. The contract
12criteria shall be established by rule, pursuant to the Illinois
13Administrative Procedure Act. The Department may lease any of
14its facilities for activities during the State Fair.
15    (e) Advertising. The Illinois State Fair in Springfield and
16the DuQuoin State Fair shall have the power and authority to
17sell or exchange advertising rights in all of its publications
18and printed materials. The sale of advertising shall be subject
19to the rules promulgated by the Department, pursuant to the
20Illinois Administrative Procedure Act. All income derived from
21the sale of advertising at the Illinois State Fair in
22Springfield and the DuQuoin State Fair shall be deposited into
23the State Fair Fund. All income derived from the sale of
24advertising at the DuQuoin State Fair shall be deposited into
25the Agricultural Premium Fund.
26    (f) Veterans. On the day set aside as Veterans Day,

1honorably discharged veterans and members of their families
2shall be admitted without admission charge upon presentation of
3identification of any of the following: honorable discharge
4certificate, or photostatic copy thereof, or a paid up
5membership card in any recognized veterans organization.
6    (g) Government functions. The Governor, Lieutenant
7Governor, Attorney General, Secretary of State, Treasurer,
8Comptroller, President and Minority Leader of the Senate, and
9Minority Leader of the House of Representatives shall be
10afforded space for official governmental functions, without
11charge, during the State Fair and the DuQuoin State Fair.

14    Sec. 10. The Department may enter into contracts with other
15government agencies to assist them in the operation of each
16State Fair and the State Fairgrounds as well as the
17requirements set forth in Section 9 of this Act.
18    The Department may cooperate with any other local, State or
19federal agency in the furtherance of the intent of this Act.
20    The Department may receive and use any donation either from
21the private or public sectors which is for betterment of each
22State Fair and the State Fairgrounds.
23    All revenues from the operation and use of any facilities
24of the Illinois State Fair at Springfield, and the Springfield
25State Fairgrounds, the DuQuoin State Fair, and the DuQuoin

1State Fairgrounds shall be deposited in the Illinois State Fair
2Fund. All revenues from the operation and use of any facilities
3of the DuQuoin State Fair and the DuQuoin State Fairgrounds
4shall be deposited into the Agricultural Premium Fund. All
5funds in the Illinois State Fair Fund shall be used by the
6Department of Agriculture in accordance with appropriation by
7the General Assembly for operation of the Illinois State Fair
8and the DuQuoin State Fair.

10    Section 99. Effective date. This Act takes effect July 1,
112017.".
