AMENDMENT TO HOUSE BILL 3095

2    AMENDMENT NO. ______. Amend House Bill 3095 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Police Act is amended by changing
5Section 9 as follows:
 
6    (20 ILCS 2610/9)  (from Ch. 121, par. 307.9)
7    Sec. 9. Appointment; qualifications.
8    (a) Except as otherwise provided in this Section, the
9appointment of Department of State Police officers shall be
10made from those applicants who have been certified by the Board
11as being qualified for appointment. All persons so appointed
12shall, at the time of their appointment, be not less than 21
13years of age, or 20 years of age and have successfully
14completed 2 years of law enforcement studies at an accredited
15college or university. Any person appointed subsequent to
16successful completion of 2 years of such law enforcement

1studies shall not have power of arrest, nor shall he be
2permitted to carry firearms, until he reaches 21 years of age.
3In addition, all persons so certified for appointment shall be
4of sound mind and body, be of good moral character, be citizens
5of the United States, have no criminal records, possess such
6prerequisites of training, education and experience as the
7Board may from time to time prescribe, and shall be required to
8pass successfully such mental and physical tests and
9examinations as may be prescribed by the Board. Notwithstanding
10any Board rule to the contrary, all persons who meet one of the
11following requirements are deemed to have met the collegiate
12educational requirements either:
13                (i) have been honorably discharged and who
14            have been awarded a Southwest Asia Service Medal,
15            Kosovo Campaign Medal, Korean Defense Service
16            Medal, Afghanistan Campaign Medal, Iraq Campaign
17            Medal, or Global War on Terrorism Expeditionary
18            Medal by the United States Armed Forces; or
19                (ii) are active members of the Illinois
20            National Guard or a reserve component of the United
21            States Armed Forces and who have been awarded a
22            Southwest Asia Service Medal, Kosovo Campaign
23            Medal, Korean Defense Service Medal, Afghanistan
24            Campaign Medal, Iraq Campaign Medal, or Global War
25            on Terrorism Expeditionary Medal as a result of
26            honorable service during deployment on active

1            duty; ,
2                (iii) have been honorably discharged who
3            served in a combat mission by proof of hostile fire
4            pay or imminent danger pay during deployment on
5            active duty; or
6                (iv) have at least 3 years of full active and
7            continuous military duty and received an honorable
8            discharge before hiring. are deemed to have met the
9            collegiate educational requirements.
10    Preference shall be given in such appointments to persons
11who have honorably served in the military or naval services of
12the United States. All appointees shall serve a probationary
13period of 12 months from the date of appointment and during
14that period may be discharged at the will of the Director.
15However, the Director may in his or her sole discretion extend
16the probationary period of an officer up to an additional 6
17months when to do so is deemed in the best interest of the
18Department.
19    (b) Notwithstanding the other provisions of this Act, after
20July 1, 1977 and before July 1, 1980, the Director of State
21Police may appoint and promote not more than 20 persons having
22special qualifications as special agents as he deems necessary
23to carry out the Department's objectives. Any such appointment
24or promotion shall be ratified by the Board.
25    (c) During the 90 days following the effective date of this
26amendatory Act of 1995, the Director of State Police may

1appoint up to 25 persons as State Police officers. These
2appointments shall be made in accordance with the requirements
3of this subsection (c) and any additional criteria that may be
4established by the Director, but are not subject to any other
5requirements of this Act. The Director may specify the initial
6rank for each person appointed under this subsection.
7    All appointments under this subsection (c) shall be made
8from personnel certified by the Board. A person certified by
9the Board and appointed by the Director under this subsection
10must have been employed by the Illinois Commerce Commission on
11November 30, 1994 in a job title subject to the Personnel Code
12and in a position for which the person was eligible to earn
13"eligible creditable service" as a "noncovered employee", as
14those terms are defined in Article 14 of the Illinois Pension
15Code.
16    Persons appointed under this subsection (c) shall
17thereafter be subject to the same requirements and procedures
18as other State police officers. A person appointed under this
19subsection must serve a probationary period of 12 months from
20the date of appointment, during which he or she may be
21discharged at the will of the Director.
22    This subsection (c) does not affect or limit the Director's
23authority to appoint other State Police officers under
24subsection (a) of this Section.
