SYNOPSIS AS INTRODUCED:
 
20 ILCS 2305/8.5 new
105 ILCS 5/10-20.60 new
105 ILCS 5/34-18.53 new

    Amends the Department of Public Health Act and the School Code. Provides that school districts may serve students produce grown and harvested by students in school-owned or community gardens if the produce meets requirements adopted by rule by the Department of Public Health. Requires the requirements to include, but not be limited to, testing soil and water used in the growing of the produce for contaminants. Makes similar changes to the Article concerning the Chicago school district.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Act is amended
5by adding Section 8.5 as follows:
 
6    (20 ILCS 2305/8.5 new)
7    Sec. 8.5. School-grown produce. The Department of Public
8Health shall adopt rules in accordance with Sections 10-20.60
9and 34-18.53 of the School Code.
 
10    Section 10. The School Code is amended by adding Sections
1110-20.60 and 34-18.53 as follows:
 
12    (105 ILCS 5/10-20.60 new)
13    Sec. 10-20.60. School-grown produce. A school district may
14serve students produce grown and harvested by students in
15school-owned or community gardens if the produce meets
16requirements adopted by rule by the Department of Public
17Health. The requirements shall include, but are not limited to,
18testing soil and water used in the growing of the produce for
19contaminants.
