1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-650 as follows:
 
7    (20 ILCS 2310/2310-650)
8    Sec. 2310-650. Influenza vaccination program.
9    (a) As used in this Section, "medically contraindicated"
10means that administration of an influenza vaccine to an
11employee would likely be detrimental to the employee's health.
12    (b) The Department of Public Health may require any
13facility licensed by the Department to implement an influenza
14vaccination program that ensures that the employees of the
15facility are offered the opportunity to be vaccinated against
16seasonal influenza and any other novel or pandemic influenza
17viruses as vaccines become available. The Department may adopt
18rules setting forth the requirements of the influenza
19vaccination program. A health care employee may decline the
20offer of vaccination if the vaccine is medically
21contraindicated, if the vaccination is against the employee's
22religious beliefs, or if the employee has already been
23vaccinated. General philosophical or moral reluctance to

1influenza vaccinations does not provide a sufficient basis for
2an exemption.

4    Section 99. Effective date. This Act takes effect July 1,
52018.
