AMENDMENT TO HOUSE BILL 2856

2    AMENDMENT NO. ______. Amend House Bill 2856 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Boxing and Full-contact Martial Arts Act is
5amended by changing Sections 1, 6, and 12 as follows:
 
6    (225 ILCS 105/1)  (from Ch. 111, par. 5001)
7    (Section scheduled to be repealed on January 1, 2022)
8    Sec. 1. Short title and definitions.
9    (a) This Act may be cited as the Boxing and Full-contact
10Martial Arts Act.
11    (b) As used in this Act:
12        "Department" means the Department of Financial and
13    Professional Regulation.
14        "Secretary" means the Secretary of Financial and
15    Professional Regulation.
16        "Board" means the State of Illinois Athletic Board

1    established pursuant to this Act.
2        "License" means the license issued for promoters,
3    professionals, or officials in accordance with this Act.
4        "Professional contest" means a boxing or full-contact
5    martial arts competition in which all of the participants
6    competing against one another are professionals and where
7    the public is able to attend or a fee is charged.
8        "Permit" means the authorization from the Department
9    to a promoter to conduct professional or amateur contests,
10    or a combination of both.
11        "Promoter" means a person who is licensed and who holds
12    a permit to conduct professional or amateur contests, or a
13    combination of both.
14        Unless the context indicates otherwise, "person"
15    includes, but is not limited to, an individual,
16    association, organization, business entity, gymnasium, or
17    club.
18        "Judge" means a person licensed by the Department who
19    is located at ringside or adjacent to the fighting area
20    during a professional contest and who has the
21    responsibility of scoring the performance of the
22    participants in that professional contest.
23        "Referee" means a person licensed by the Department who
24    has the general supervision of and is present inside of the
25    ring or fighting area during a professional contest.
26        "Amateur" means a person registered by the Department

1    who is not competing for, and has never received or
2    competed for, any purse or other article of value, directly
3    or indirectly, either for participating in any contest or
4    for the expenses of training therefor, other than a
5    non-monetary prize that does not exceed $50 in value.
6        "Professional" means a person licensed by the
7    Department who competes for a money prize, purse, or other
8    type of compensation in a professional contest held in
9    Illinois.
10        "Second" means a person licensed by the Department who
11    is present at any professional contest to provide
12    assistance or advice to a professional during the contest.
13        "Matchmaker" means a person licensed by the Department
14    who brings together professionals to compete in contests.
15        "Manager" means a person licensed by the Department who
16    is not a promoter and who, under contract, agreement, or
17    other arrangement, undertakes to, directly or indirectly,
18    control or administer the affairs of professionals.
19        "Timekeeper" means a person licensed by the Department
20    who is the official timer of the length of rounds and the
21    intervals between the rounds.
22        "Purse" means the financial guarantee or any other
23    remuneration for which contestants are participating in a
24    professional contest.
25        "Physician" means a person licensed to practice
26    medicine in all its branches under the Medical Practice Act

1    of 1987.
2        "Martial arts" means a discipline or combination of
3    different disciplines that utilizes sparring techniques
4    without the intent to injure, disable, or incapacitate
5    one's opponent, such as, but not limited to, Karate, Kung
6    Fu, Judo, Jujutsu, Tae Kwon Do, and Kyuki-Do.
7        "Full-contact martial arts" means the use of a singular
8    discipline or a combination of techniques from different
9    disciplines of the martial arts, including, without
10    limitation, full-force grappling, kicking, and striking
11    with the intent to injure, disable, or incapacitate one's
12    opponent.
13        "Amateur contest" means a boxing or full-contact
14    martial arts competition in which all of the participants
15    competing against one another are amateurs and where the
16    public is able to attend or a fee is charged.
17        "Contestant" means a person who competes in either a
18    boxing or full-contact martial arts contest.
19        "Address of record" means the designated address
20    recorded by the Department in the applicant's or licensee's
21    application file, license file, or registration file as
22    maintained by the Department's licensure maintenance unit.
23    It is the duty of the applicant or licensee to inform the
24    Department of any change of address and those changes must
25    be made either through the Department's website or by
26    contacting the Department.

1        "Bout" means one match between 2 contestants.
2        "Sanctioning body" means an organization approved by
3    the Department under the requirements and standards stated
4    in this Act and the rules adopted under this Act to act as
5    a governing body that sanctions professional or amateur
6    contests.
7        "Kickboxing" means a form of boxing in which only
8    punches and kicks are allowed.

13    Sec. 6. Restricted contests and events. (a) All
14professional and amateur contests, or a combination of both, in
15which physical contact is made are prohibited in Illinois
16unless authorized by the Department pursuant to the
17requirements and standards stated in this Act and the rules
18adopted pursuant to this Act. This Section subsection (a) does
19not apply to any of the following:
20        (1) Amateur boxing or full-contact martial arts
21    contests conducted by accredited secondary schools,
22    colleges, or universities, although a fee may be charged.
23        (2) Amateur boxing contests that are sanctioned by USA
24    Boxing or any other sanctioning organization approved by
25    the Association of Boxing Commissions.

1        (3) Amateur boxing or full-contact martial arts
2    contests conducted by a State, county, or municipal entity.
3        (4) Amateur martial arts contests that are not defined
4    as full-contact martial arts contests under this Act,
5    including, but not limited to, Karate, Kung Fu, Judo,
6    Jujutsu, Tae Kwon Do, and Kyuki-Do.
7        (5) Full-contact martial arts contests, as defined by
8    this Act, that are recognized by the International Olympic
9    Committee or are contested in the Olympic Games and are not
10    conducted in an enclosed fighting area or ring.
11        (6) Kickboxing contests that are sanctioned by
12    nationally recognized sanctioning bodies, such as the
13    World Association of Kickboxing Organizations USA, KICK
14    International, the International Kickboxing Federation,
15    the International Sport Karate and Kickboxing Association,
16    and the World Kickboxing Association.
17    No other amateur boxing or full-contact martial arts
18contests shall be permitted unless authorized by the
19Department.
20    (b) The Department shall have the authority to determine
21whether a professional or amateur contest is exempt for
22purposes of this Section.

1    (Section scheduled to be repealed on January 1, 2022)
2    Sec. 12. Professional or amateur contests.
3    (a) The professional or amateur contest, or a combination
4of both, shall be held in an area where adequate neurosurgical
5facilities are immediately available for skilled emergency
6treatment of an injured professional or amateur.
7    (b) Each professional or amateur shall be examined before
8the contest and promptly after each bout by a physician. The
9physician shall determine, prior to the contest, if each
10professional or amateur is physically fit to compete in the
11contest. After the bout the physician shall examine the
12professional or amateur to determine possible injury. If the
13professional's or amateur's physical condition so indicates,
14the physician shall recommend to the Department immediate
15medical suspension. The physician or a licensed paramedic must
16check the vital signs of all contestants as established by
17rule.
18    (c) The physician may, at any time during the professional
19or amateur bout, stop the professional or amateur bout to
20examine a professional or amateur contestant and may direct the
21referee to terminate the bout when, in the physician's opinion,
22continuing the bout could result in serious injury to the
23professional or amateur. If the professional's or amateur's
24physical condition so indicates, the physician shall recommend
25to the Department immediate medical suspension. The physician
26shall certify to the condition of the professional or amateur

1in writing, over his signature on forms provided by the
2Department. Such reports shall be submitted to the Department
3in a timely manner.
4    (d) No professional or amateur contest, or a combination of
5both, shall be allowed to begin or be held unless at least one
6physician, at least one EMT and one paramedic, and one
7ambulance have been contracted with solely for the care of
8professionals or amateurs who are competing as defined by rule.
9    (e) No professional boxing bout shall be more than 12
10rounds in length. The rounds shall not be more than 3 minutes
11each with a one minute interval between them, and no
12professional boxer shall be allowed to participate in more than
13one contest within a 7-day period.
14    The number and length of rounds for all other professional
15or amateur boxing or full-contact martial arts contests, or a
16combination of both, shall be determined by rule.
17    (f) The number and types of officials required for each
18professional or amateur contest, or a combination of both,
19shall be determined by rule.
20    (g) The Department or its representative shall have
21discretion to declare a price, remuneration, or purse or any
22part of it belonging to the professional withheld if in the
23judgment of the Department or its representative the
24professional is not honestly competing.
25    (h) The Department shall have the authority to prevent a
26professional or amateur contest, or a combination of both, from

1being held and shall have the authority to stop a professional
2or amateur contest, or a combination of both, for noncompliance
3with any part of this Act or rules or when, in the judgment of
4the Department, or its representative, continuation of the
5event would endanger the health, safety, and welfare of the
6professionals or amateurs or spectators. The Department's
7authority to stop a contest on the basis that the professional
8or amateur contest, or a combination of both, would endanger
9the health, safety, and welfare of the professionals or
10amateurs or spectators shall extend to any professional or
11amateur contest, or a combination of both, regardless of
12whether that amateur contest is exempted from the prohibition
13in Section 6 of this Act. Department staff, or its
14representative, may be present at any full-contact martial arts
15contest with scheduled amateur bouts.
16    (i) Participants of kickboxing contests must use, at a
17minimum, 10 ounce gloves.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
