    Amends the School Code. Provides that it is the power of a school board to hire school social workers. Sets forth qualifications to use the title of "school social worker". Provides that school districts may employ a sufficient number of school social workers to address the needs of their students and schools and may maintain the nationally recommended student-to-school social worker ration of 250 to 1. Prohibits school social workers from providing services outside their employment to any student in the district or districts that employ the school social worker. Makes conforming changes. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
514-1.09a and by adding Sections 10-20.60 and 34-18.53 as
6follows:
 
7    (105 ILCS 5/10-20.60 new)
8    Sec. 10-20.60. School social worker. A school board may
9employ school social workers who have graduated with a master's
10or higher degree in social work from an accredited graduate
11school of social work and have such additional qualifications
12as may be required by the State Board of Education and who hold
13a Professional Educator License with a school support personnel
14endorsement for school social work pursuant to Section 21B-25
15of this Code. Only persons so licensed and endorsed may use the
16title "school social worker" and may offer school social work
17services. A school social worker may provide individual and
18group services to the general student population and to
19students with disabilities pursuant to Article 14 of this Code
20and rules set forth in 23 Ill. Adm. Code 226, Special
21Education, adopted by the State Board of Education and may
22provide support and consultation to administrators, teachers,
23and other school personnel consistent with their professional

1qualifications and the provisions of this Code and other
2applicable laws. School districts may employ a sufficient

2with disabilities and requirements for the treatment of
3children with disabilities between the ages of 3 and 21. School
4social workers may make evaluations, recommendations or
5interventions regarding the placement of children in
6educational programs or special education classes. However, a
7school social worker shall not provide such services outside
8his or her employment to any student in the district or
9districts which employ such school social worker.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
