SYNOPSIS AS INTRODUCED:
 
15 ILCS 305/25 new

    Amends the Secretary of State Act. Provides that the Secretary of State is authorized to solicit and accept sponsorship for publications printed and distributed by the Secretary's office. Provides that the Secretary shall not solicit or accept applications or enter into a sponsorship agreement with certain specified persons or entities. Establishes requirements and procedures for sponsorship of publications. Requires that all funds received by the Secretary for sponsorship of publications shall be deposited into the Secretary of State's Grant Fund. Provides that the Secretary shall adopt rules under the Illinois Administrative Procedure Act as necessary for the implementation of publication sponsorship. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4Section 5. The Secretary of State Act is amended by adding
5Section 25 as follows:
 
6    (15 ILCS 305/25 new)
7    Sec. 25. Publication sponsorship. The Secretary of State is
8authorized to solicit and accept sponsorship for publications
9printed and distributed by the Secretary's office. A sponsor
10shall pay a fee for the privilege of having a name or logo
11printed on the publication. The Secretary shall select sponsors
12by an application process established by administrative rule.
13The Secretary shall not solicit or accept applications or enter
14into a sponsorship agreement with any of the following persons
15or entities: (1) any person or entity licensed or regulated by
16the Secretary, except a driver's license holder; (2) any person
17or entity manufacturing or distributing pharmaceuticals,
18medical marijuana, or alcohol; or (3) any person holding any
19elected office in this State, any candidate for any elected
20office in this State, any political committee registered with
21the Federal Elections Commission or State Board of Elections,
22or any entity that makes independent expenditures on behalf of
23a person holding elected office or a candidate for elected

1office.
2    The Secretary shall have sole discretion in determining
3which, if any, of the applications to accept, and will exercise
4final control over the design, layout, type face, and all other
5aspects of the content, size, and appearance of registration
6renewal notices. In deciding whether to accept a proposal, the
7Secretary may consider the amount of money a potential sponsor
8has offered to pay for sponsorship of a publication, and
9whether the goods or services offered by a potential sponsor
10have a nexus to the responsibilities, operations, and services
11provided by the Secretary of State's Office.
12    All funds received by the Secretary for sponsorship of
13publications shall be deposited into the Secretary of State's
14Grant Fund.
15    The Secretary of State shall adopt rules under the Illinois
16Administrative Procedure Act as necessary for the
17implementation of this publication sponsorship program.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.
