AMENDMENT TO HOUSE BILL 300

2    AMENDMENT NO. ______. Amend House Bill 300 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 11-1006 as follows:
 
6    (625 ILCS 5/11-1006)  (from Ch. 95 1/2, par. 11-1006)
7    Sec. 11-1006. Pedestrians soliciting rides or business.
8    (a) No person shall stand in a roadway for the purpose of
9soliciting a ride from the driver of any vehicle.
10    (b) No person shall stand on a highway for the purpose of
11soliciting employment or business from the occupant of any
12vehicle.
13    (c) No person shall stand on a highway for the purpose of
14soliciting money or contributions from the occupant of any
15vehicle except within a municipality when expressly permitted
16by municipal ordinance. The local municipality, city, village,

1or other local governmental entity in which the solicitation
2takes place shall determine by ordinance where and when
3solicitations may take place based on the safety of the
4solicitors and the safety of motorists. The decision shall also
5take into account the orderly flow of traffic and may not allow
6interference with the operation of official traffic control
7devices. The soliciting agency shall be:
8        1. registered with the Attorney General as a charitable
9    organization as provided by "An Act to regulate
10    solicitation and collection of funds for charitable
11    purposes, providing for violations thereof, and making an
12    appropriation therefor", approved July 26, 1963, as
13    amended;
14        2. engaged in a Statewide fund raising activity; and
15        3. liable for any injuries to any person or property
16    during the solicitation which is causally related to an act
17    of ordinary negligence of the soliciting agent.
18    Any person engaged in the act of solicitation under an
19ordinance shall be 16 years of age or more and shall be wearing
20a high visibility vest.
21    (d) No person shall stand on or in the proximity of a
22highway for the purpose of soliciting the watching or guarding
23of any vehicle while parked or about to be parked on a highway.
24    (e) Every person who is convicted of a violation of this
25Section shall be guilty of a Class A misdemeanor.
