AMENDMENT TO HOUSE BILL 244

2    AMENDMENT NO. ______. Amend House Bill 244, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Cannabis Control Act is amended by changing
6Section 5.2 as follows:
 
7    (720 ILCS 550/5.2)  (from Ch. 56 1/2, par. 705.2)
8    Sec. 5.2. Delivery of cannabis on school grounds.
9    (a) Any person, other than an enrolled student, who
10violates subsection (e) of Section 5 in any school, on the real
11property comprising any school, or any conveyance owned, leased
12or contracted by a school to transport students to or from
13school or a school related activity, or on any public way
14within 1,000 feet of the real property comprising any school,
15or any conveyance owned, leased or contracted by a school to
16transport students to or from school or a school related

1activity, is guilty of a Class 1 felony, the fine for which
2shall not exceed $200,000;
3    (b) Any person, other than an enrolled student, who
4violates subsection (d) of Section 5 in any school, on the real
5property comprising any school, or any conveyance owned, leased
6or contracted by a school to transport students to or from
7school or a school related activity, or on any public way
8within 1,000 feet of the real property comprising any school,
9or any conveyance owned, leased or contracted by a school to
10transport students to or from school or a school related
11activity, is guilty of a Class 2 felony, the fine for which
12shall not exceed $100,000;
13    (c) Any person, other than an enrolled student, who
14violates subsection (c) of Section 5 in any school, on the real
15property comprising any school, or any conveyance owned, leased
16or contracted by a school to transport students to or from
17school or a school related activity, or on any public way
18within 1,000 feet of the real property comprising any school,
19or any conveyance owned, leased or contracted by a school to
20transport students to or from school or a school related
21activity, is guilty of a Class 3 felony, the fine for which
22shall not exceed $50,000;
23    (d) Any person, other than an enrolled student, who
24violates subsection (b) of Section 5 in any school, on the real
25property comprising any school, or any conveyance owned, leased
26or contracted by a school to transport students to or from

1school or a school related activity, or on any public way
2within 1,000 feet of the real property comprising any school,
3or any conveyance owned, leased or contracted by a school to
4transport students to or from school or a school related
5activity, is guilty of a Class 4 felony, the fine for which
6shall not exceed $25,000;
7    (e) Any person, other than an enrolled student, who
8violates subsection (a) of Section 5 in any school, on the real
9property comprising any school, or any conveyance owned, leased
10or contracted by a school to transport students to or from
11school or a school related activity, on any public way within
121,000 feet of the real property comprising any school, or any
13conveyance owned, leased or contracted by a school to transport
14students to or from school or a school related activity, is
15guilty of a Class A misdemeanor.
16    (f) As used in this Section:
17        "Charter school" has the meaning ascribed to the term
18    in Section 27A-5 of the School Code.     
19        "Enrolled student" means a student registered at an
20    active and operational public, private, charter, or
21    parochial elementary or secondary school, community
22    college, college, or university.
23        "School" means an active and operational public,
24    private, charter, or parochial elementary or secondary
25    school, community college, college, or university and
26    includes the grounds of an active and operational school,

1    if the offense is committed when school is in session,
2    children are present, or when school related activity
3    occurs; and "school related activity" means any sporting,
4    social, academic, or other activity for which students'
5    attendance or participation is sponsored, organized, or
6    funded in whole or in part by a school or school district.
