Representative Curry led the House in the Pledge of Allegiance. By direction of the Speaker, a roll call was taken to ascertain the attendance of Members, as follows: 113 present. 11 [April 25, 2001] AGREED RESOLUTION The following resolutions were offered and placed on the Calendar on the order of Agreed Resolutions. HOUSE RESOLUTION 230 Offered by Representative Saviano - Cowlishaw - Capparelli - Persico: WHEREAS, Dr. Vincent Bufalino will be awarded the first annual Coeur d'Or Award (Heart of Gold) by the American Heart Association, Chicago Division, at the 19th annual Heart Ball on May 4, 2001; and WHEREAS, The Coeur d'Or, also known as the Heart of Gold Award, is given annually to acknowledge an individual who through his or her professional accomplishments and personal commitment, has advanced the mission of the American Heart Association to reduce disability and death from heart and stroke; and WHEREAS, Dr. Bufalino currently serves as the President and Chief Executive Officer of Midwest Heart Specialists and as President and Medical Director of Edward Cardiovascular Institute; in addition, he serves as a consulting cardiologist at Edward Hospital, Valley West Community Hospital, Good Samaritan Hospital, Elmhurst Hospital, and Central DuPage Hospital; and WHEREAS, Dr. Bufalino was born and raised in the Chicago metropolitan area; he received his undergraduate degree in Biology magna cum laude in 1974 from Loyola University, and his Doctorate in Medicine from the Loyola Stritch School of Medicine; he continued his training as an intern and resident in the internal medicine program at the Loyola University Foster G. McGaw Hospital, where he was named chief resident in his final year of his residency program and recognized by the Illinois Society of Internal Medicine as an outstanding resident; and WHEREAS, Dr, Bufalino has been a volunteer with the American Heart Association since 1983, serving in numerous county, regional, and national positions; he has served as vice president on the national board representing both the Midwest and abroad; he continues to serve on multiple national committees related to national public policy and advocacy; he was recently appoint to the position of chairman of the Emergency Cardiac Care Committee for the American Heart Association with additional responsibilities of directing the CPR and Advanced Cardiac Life Support Programs for the United States; and WHEREAS, Dr. Bufalino has chaired the Midwest Heart Research Foundation since its inception in 1988; he has also held leadership positions with the DuPage County Heart Association, the American Heart Association of Metropolitan Chicago, and the American Heart Association North Central Region; he has served on the Board of Directors of the American Heart Association, and has served as a delegate to the American Heart Association National Delegate Assembly; he currently serves as Chairman of the Emergency Cardiac Care Business Committee, American Heart Association - National, and serves as a member of the Council in Cardiopulmonary and Critical Care - ECC Research Funding Committee; and WHEREAS, Dr. Bufalino has been the recipient of the American Heart Association Physician of the Year for the United States in 1997, and the 1998 recipient of the IANU Michelangelo Award, Man of the Year; and WHEREAS, Dr. Bufalino remains an active leader in his community, where he serves as president of the local school board, elementary school basketball coach, and active sponsor of the local parochial high school; and WHEREAS, Dr. Bufalino resides in Glen Ellyn, Illinois, with his wife, Joan, and their sons, Dominick and Joseph; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate Dr. Vincent J. Bufalino on being the recipient of the first annual Coeur d'Or (Heart of Gold) Award presented by the American Heart Association, Chicago Division; and be it further

HOUSE RESOLUTION 232 Offered by Representative Hamos: WHEREAS, The members of the Illinois House of Representatives are pleased to recognize milestone events in the lives of the citizens of the State of Illinois; and WHEREAS, It has come to our attention that Joel Farber is stepping down from his duties as Commissioner of the Skokie Park District this year; and WHEREAS, Joel Farber was elected to the position of Commissioner in 1995, after serving 10 years on the Skokie Park District Citizens Committee, and as Chair of the committee for 5 years; and WHEREAS, Joel Farber has overseen the creation of the Skokie Sports Park, renovations to the Oakton Community Center, and development of the Devonshire Cultural Center, Tot Learning Center, Emily Oaks Nature Center, and many parks; and WHEREAS, Joel Farber always made a conscious effort to attend Park District and other community events in order to improve the quality of life for Skokie residents; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate Joel Farber for his dedication as Commissioner of the Skokie Park District and for his many years of service to the Skokie community, and we wish him well in all of his future endeavors; and be it further RESOLVED, That a suitable copy of this resolution be presented to Joel Farber as an expression of our esteem. HOUSE RESOLUTION 234 Offered by Representative Parke: WHEREAS, The members of the Illinois House of Representatives are pleased to recognize milestone events in the lives of citizens of the State of Illinois; and WHEREAS, It has come to our attention that Dr. Gerald D. Chapman is retiring from his duties as superintendent of Township High School District 211 this year; and WHEREAS, Dr. Gerald Chapman currently serves as superintendent in the State of Illinois' largest high school district; the five high schools that he has administrative responsibility for are James B. Conant, William Fremd, Hoffman Estates, Palatine, and Schaumburg; all five schools have a combined enrollment of more than 12,000 students; and WHEREAS, Dr. Chapman earned his bachelor of science degree from Northern Illinois University, his master's degree from Northwestern University, and was awarded a doctorate in school administration from Indiana University in 1972; and WHEREAS, Dr. Chapman began his illustrious teaching career in Township High School District 211 in 1965 as a mathematics teacher at William Fremd High School where he additionally served as a student activity director, mathematics department chair, and assistant principal; he was named Associate Principal at Hoffman Estates High School from 1973 to 1974; he was appointed assistant superintendent in 1974 of Township High School District 211, and became superintendent by 1990; and WHEREAS, During his tenure as superintendent, Palatine, Schaumburg, and James B. Conant High Schools received numerous recognitions for excellence in education by the United States Department of Education that include being named the "New American High School" in May 2000, being the recipient of the Blue Ribbon in May 2000, being rated as one of the top 99 high schools in America by U.S. News and World Report magazine; and recognizing District 211 as the nation's best high school district by Expansion Management; and WHEREAS, Dr. Chapman has authored several articles and performed
13 [April 25, 2001] numerous lectures during his career that include providing quarterly guest articles for the Daily Herald; and presenting his "View of the Superintendency from the Superintendency" for the Illinois Association of School Administrators; and WHEREAS, Dr. Chapman has been an active supporter of the United Way, and under his leadership, Township High School District 211 has become a major suburban school contributor to the United Way; other organizations that Dr. Chapman has been affiliated with over the years include as member and past chair of the Illinois State Board of Education Prairie State Examination Advisory Committee, chair of the Palatine Township Cemetery Committee, member of the Community Advisory Board and Academic and Student Affairs Committee at Roosevelt University, trustee at Northwestern University A.P. Consortium, organization leader of the American Heart Association Heart Walk; and as member of the Board of Directors of Northwest 2001, the Greater Palatine Chamber of Commerce & Industry, the Illinois State Board of Education "Right to Read" Initiative, the Suburban Cook County Regional Office of Education, Palatine Park District, Palatine Lions Club, and the St. Paul United Church of Christ in Palatine; and WHEREAS, Dr. Chapman has been the recipient of numerous awards and honors during his tenure that include being named Illinois Superintendent of the Year for 2000 by the American Association of School Administrators, being recognized in 1988 and 1998 by the Illinois State Board of Education with "Those Who Excel" Awards, and being honored by the villages of Palatine, Hoffman Estates, and Schaumburg with separate "Dr. Gerald Chapman Days" in May 2000; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate Dr. Gerald D. Hudson of Worth has announced his May 15, 2001 retirement as Deputy Chief of Police of the Worth Police Department; and WHEREAS, James T. Hudson is a 44-year resident of the Village of Worth, who has attended Worth Elementary School, Harold L. Richards Community High School, and the FBI National Academy in Quantico, Virginia; and WHEREAS, He began his career as a part-time police officer in 1970, served as a patrolman from 1971 to 1989, was promoted to Sergeant in 1989, and became Deputy Chief in 1999; and WHEREAS, James T. Hudson was a volunteer fireman in the Village of Worth, a member of the South Suburban Police Chiefs Association, the 5th District Chiefs Association, the Illinois Police Chiefs Association, the Northern Chapter of the FBI National Academy Association, the South Suburban Juvenile Officers Association, and a member of the Worth Township Youth Service Bureau; and WHEREAS, James T. Hudson, during his 32 year career of distinguished service has received 50 department commendations, numerous citizen honorable mentions, the Cook County Sheriffs Law Enforcement Award of Merit, and has earned the respect and admiration of all who have grown to know him; and WHEREAS, James T. HOUSE RESOLUTION 236 Offered by Representative Granberg: WHEREAS, The members of the Illinois House of Representatives are pleased to honor the veterans from the State of Illinois who serviced during World War II, the Korean Conflict, the Vietnam Confict, and the Persian Gulf War; and WHEREAS, On May 28, 2001, the town of Brownstown, Illinois is celebrating its Sixth Annual Memorial Day Service in honor of the town's veterans; and WHEREAS, After the previous year's Memorial Day service, VFW Post 9770 decided to create a monument for all foreign war veterans, including those fortunate enough to return to American soil; and WHEREAS, As a result of donations and fundraisers, a black granite memorial that measures eight feet high and sixteen feet long and holds more than 600 names from World War II to Desert Storm, proudly rests in the Central Park of Brownstown; and WHEREAS, A lasting memorial requires a memorable dedication, which is happening at the Sixth Annual Memorial Day Service; the service will include songs, a band performance, a seven-gun salute, a special echo performance of Taps with two bugle players, a planned low-level jet flyby, and an address by John W. HOUSE RESOLUTION 231 Offered by Representative Soto: WHEREAS, Cinco de Mayo is a date of great importance for the Mexican and Chicano communities in the United States; and WHEREAS, In 1862, the French army, led by Napoleon III, began its advance into Mexico to claim territory leading to a ferocious battle known as the "Batalla de Puebla"; the French army met resistance from 5,000 ill-equipped Mestizo and Zapotec Indians under the command of General Ignacio Zaragoza; the battle, which occurred on May 5, marks the victory of the Mexican Army over the French, who were forced to retreat; and WHEREAS, Although the Mexican army was eventually defeated, the "Batalla de Puebla" now represents a symbol of Mexican unity and patriotism; and WHEREAS, As a result of this victory, Mexico demonstrated to the world that Mexico and Latin America are willing to defend themselves of any foreign intervention, especially those from imperialist states; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we recognize "Cinco de Mayo", and join with those who celebrate May 5 as a day of remembrance for all the patriots of Mexico and Latin America who fought for independence from France in 1862. HOUSE RESOLUTION 233 Offered by Representative Younge: WHEREAS, It is the policy of the State of Illinois to promote peace and friendship with African nations; and WHEREAS, The General Assembly wishes to promote service in African nations by men and women of this State qualified for service abroad and willing to serve under conditions of hardship if necessary; and WHEREAS, The General Assembly wishes to help the peoples of African nations in meeting their needs for trained manpower, particularly in meeting the basic needs of those living in the poorest areas of those countries; and
17 [April 25, 2001] WHEREAS, Women in developing countries play a significant role in economic production, family support, and the overall development process; and WHEREAS, Ninety-five percent of the disabled people in the world are among the poorest of the poor; and WHEREAS, Urban inner city schools have a demonstrated need for qualified personnel and role models for African-American youth; and WHEREAS, The General Assembly wishes to promote a better understanding of the citizens of this State on the part of the peoples of African nations and a better understanding of other peoples on the part of the citizens of this State; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that there is created the Illinois Africa-America Peace Brigade Advisory Committee consisting of 2 members of the general public appointed by the Governor, 2 members of the House appointed by the Speaker of the House, and 2 members of the House appointed by the Minority Leader of the House, all of whom shall serve without compensation but shall be reimbursed for their reasonable and necessary expenses from funds appropriated for that purpose; and be it further RESOLVED, That the Committee shall evaluate the possibilities for establishing an Illinois Africa-America Peace Brigade to promote volunteerism in African nations and in urban inner city schools in this State and the types of programs and activities that could be carried out by Illinois Africa-America Peace Brigade volunteers, giving particular attention to programs and activities aimed at integrating women and disabled persons into the economies of African nations; and be it further RESOLVED, That the Committee shall make recommendations to the Governor and the General Assembly regarding the establishment, purposes, and programs of an Illinois Africa-America Peace Brigade. HOUSE JOINT RESOLUTION 30 Offered by Representative Ryder: WHEREAS, On October 12, 2000, the State Board of Education adopted an amendment by peremptory rulemaking for rules entitled "Certification" (23 Ill. Adm. Code 25; 24 Ill. Reg. 16109); and WHEREAS, The peremptory amendment adopted by the State Board of Education repeals a rule limiting special education teachers with certificates endorsed for specific disabilities to teaching only students with those disabilities; and WHEREAS, This rulemaking is in response to a court order issued on September 12, 2000 in Corey H., et al., v. Board of Education of City of Chicago, et al., No. 92 C 3409 (9/12/00, U.S. District Court for the Northern District of Illinois, Eastern Division); among the dispositions by the court-appointed monitor was a requirement that the State Board of Education repeal, via peremptory rulemaking, categorical certification language from 23 Ill. Adm. Code 25, Appendix C; and WHEREAS, The Joint Committee on Administrative Rules, during its review of the peremptory rulemaking as directed by the Illinois Administrative Procedure Act, determined that the continued enforcement of this rulemaking would constitute a serious threat to the public interest, safety, and welfare and particularly the welfare of this State's special education students; implementation of this rulemaking may result in unqualified teachers being assigned to students for whom the teacher has no training or preparation; and WHEREAS, Based on this determination, the Joint Committee on Administrative Rules suspended this rulemaking; and WHEREAS, Because Section 5-125 of the Illinois Administrative Procedure Act states that a suspension of an agency's peremptory rulemaking is effective for a period of at least 180 days, the suspension issued by the Joint Committee on Administrative Rules, which commenced on February 21, 2001, will terminate on August 19, 2001, unless continued by the adoption of this joint resolution by both houses of the General Assembly as provided in subsection (c) of Section
[April 25, 2001] 18 5-125 of the Illinois Administrative Procedure Act; and WHEREAS, On October 27, 2000, the State Board of Education adopted new rules through a second peremptory rulemaking entitled "Standards for Certification in Special Education" (23 Ill. Adm. Code 28; 24 Ill. Reg. 16738); and WHEREAS, The peremptory rules adopted by the State Board of Education create 2 categories of special education teachers, Learning Behavior Specialist (LBS) I and II, and create a common core of standards for all special education teachers and specific content-area standards for LBS I (deaf or hard-of-hearing, blind or visually impaired, or a combination of both) and LBS II (speech-language pathologists, early childhood special education teachers, and learning behavior specialists); LBS II persons can be further categorized as specialists, i.e., as a transition specialist, technology specialist, bilingual special education specialist, blind specialist, behavior intervention specialist, curriculum adaptation specialist, or multiple disabilities specialist; and WHEREAS, The standards will affect both special education teachers and the academic programs that prepare them; beginning on July 31, 2002, special education teacher preparation programs will be not approved by the State Board of Education if they do not include these new common core standards; beginning on January 1, 2003, any examination required for special education certification must assess the candidate's competence in relation to these standards; for each category of special education (deaf, early childhood, etc.), a teacher must understand the foundations of special education, characteristics of the relevant category of students, assessment procedures, instructional planning and delivery, learning environments, collaborative relationships, professional conduct and leadership, and reflection and professional growth; and WHEREAS, This second peremptory rulemaking is in response to the court order in which the State Board of Education was directed to adopt the peremptory rules for special education teacher certification standards; and WHEREAS, The Joint Committee on Administrative Rules, during its review of the second peremptory rulemaking as directed by the Illinois Administrative Procedure Act, determined that the continued enforcement of this rulemaking would constitute a serious threat to the public interest and welfare and that the reasons for the suspension are as follows: (1) educational professionals have argued that the teacher training scenario outlined in this rulemaking will result in teachers who are not as qualified to teach children with special needs as are teachers trained under the previous standards; (2) the rules place an unreasonable economic burden on special education teachers, who will be required to undergo additional training for the new certification, on school districts, which will need to hire special education teachers with appropriate credentials and to supply supplemental services to assist the children with disabilities in regular classroom instruction, on higher education facilities, which will need to revamp their teacher preparation programs to implement these new special education common core standards, and on the State Board of Education, which is charged with implementing the new certification program standards; and (3) the economic hardship being created by this rulemaking could result in the availability of fewer qualified teachers to serve special education students; and WHEREAS, Based on this determination, the Joint Committee on Administrative Rules suspended the second peremptory rulemaking; and WHEREAS, Because Section 5-125 of the Illinois Administrative Procedure Act states that a suspension of an agency's peremptory rulemaking is effective for a period of at least 180 days, the suspension issued by the Joint Committee on Administrative Rules, which commenced on January 9, 2001, will terminate on July 7, 2001, unless continued by the adoption of this joint resolution by both houses of
19 [April 25, 2001] the General Assembly as provided in subsection (c) of Section 5-125 of the Illinois Administrative Procedure Act; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that the General Assembly hereby continues the 2 suspensions issued by the Joint Committee on Administrative Rules on January 9, 2001 and February 21, 2001, respectively, of the State Board of Education's 2 peremptory rulemakings titled "Standards for Certification in Special Education" (23 Ill. Adm. Code 28; 24 Ill. Reg. 16738) and "Certification" (23 Ill. Adm. Code 25; 24 Ill. Reg. 16109); and be it further RESOLVED, That suitable copies of this resolution be delivered to the Executive Director of the Joint Committee on Administrative Rules and to the State Superintendent of Education. HOUSE JOINT RESOLUTION 31 Offered by Representative Ryder: WHEREAS, On January 1, 2000, the Illinois Commerce Commission proposed rules titled "Requirements for Businesses with Private Business Switch Service to Comply with the Emergency Telephone System Act" (83 Ill. Adm. Code 726; 24 Ill. Reg. 1); and WHEREAS, The rules proposed by the Commission established enhanced 9-1-1 emergency telephone system requirements for business entities, schools, local governments, and not-for-profit organizations unless those entities are exempted by the Emergency Telephone System Act; and WHEREAS, The General Assembly's Joint Committee on Administrative Rules (JCAR) voted to prohibit the filing of those rules for adoption on April 11, 2000 because the rules applied to schools, governmental units, and not-for-profit organizations and created an undue economic and regulatory burden on business entities; and WHEREAS, JCAR withdrew the prohibition on June 13, 2000 because the Commission modified the rules to meet JCAR's objections; and WHEREAS, The Commission adopted emergency rules effective June 13, 2000 titled "Requirements for Non-Business Entities with Private Business Switch Service to Comply with the Emergency Telephone System Act" (83 Ill. Adm. Code 727; 24 Ill. Reg. 8635) that JCAR noted contained the same provisions applicable to schools, governmental units, and not-for-profit corporations that were withdrawn by the Commission from its prior, broader rulemaking; JCAR objected to and suspended the emergency rules for 180 days on June 13, 2000; and WHEREAS, On June 23, 2000, the Commission proposed rules titled "Requirements for Non-Business Entities with Private Business Switch Service to Comply with the Emergency Telephone System Act" (83 Ill. Adm. Code 727; 24 Ill. Reg. 8454) that were identical to the suspended emergency rules; and WHEREAS, JCAR, during its review of the proposed Part 727 rulemaking, as directed by the Illinois Administrative Procedure Act, determined that the rulemaking was contrary to statute and also constituted a serious threat to the public interest and welfare; and WHEREAS, JCAR based its determination that the rule proposed by the Commission was contrary to legislative intent on the fact that the Commission exceeded its statutory authority under Section 15.6 of the Emergency Telephone System Act by extending the application of the Act to schools, local governments, and not-for-profit organizations through the emergency telephone system regulations contained in the rules; and WHEREAS, As required by the Illinois Administrative Procedure Act, strict adherence to legislative intent as expressed through statute and a concern for the well-being and welfare of Illinois citizens, including school children, are all elements of the JCAR review process; and WHEREAS, Based on the determination, JCAR prohibited the filing of the above-cited Part 727 rulemaking for adoption; and WHEREAS, Because Section 5-115 of the Illinois Administrative Procedure Act states that a filing prohibition of an agency's rulemaking is effective for a period of at least 180 days, the
