CHAPTER XI: HUMAN RIGHTS COMMISSION PART 5300 PROCEDURAL RULES SECTION 5300.450 EXTENSIONS OF TIME
Section 5300.450 Extensions of Time
a) A party's timely request for review or timely reply to the Department's response pursuant to this subsection may seek additional time to file argument and material in support. A request for additional time not exceeding 30 days shall be granted by the Commission through the issuance by the Executive Director of a written order served on the party filing the request and on the Department. A request for additional time shall be granted by the Commission, through a 3 member panel, only upon a showing of special circumstances. Any additional argument or material filed pursuant to this subsection shall be served at the same time on the Department by the party filing it. The Department shall file its response in accordance with Section 5300.430 within 30 days after receipt of the additional argument or materials.
b) The Department may request additional time to file its response by filing a written motion with the Commission, serving a copy at the same time on the party filing the request for review. A request for additional time not exceeding 30 days shall be granted by the Commission through the issuance by the Executive Director of a written order served on the party filing the request for review and on the Department. A request for additional time will be granted by the Commission, through a 3 member panel, only upon a showing of special circumstances.
