SECTION 360.510 ASSESSMENT OF PENALTIES


 

Section 360.510  Assessment of Penalties

 

a)         Grounds.  Pursuant to Section 0.05(a)(6) of the Pawnbroker Regulation Act [205 ILCS 510/0.05(a)(6)], civil penalties may be imposed against any person for each violation of any provision of the Pawnbroker Regulation Act, any rule promulgated in accordance with the Pawnbroker Regulation Act, or any order issued by the Secretary based upon the seriousness of the violation.

 

b)         Amount.  The Secretary may assess civil penalties graduated up to $1,000.

 

c)         Relevant Considerations.  In determining the amount of the civil penalty to be assessed, the Secretary shall consider the gravity of the violation, the history of previous violations, the financial resources and good faith of the person, and any such other matters as justice may require.
