SUBTITLE C: WATER POLLUTION CHAPTER I: POLLUTION CONTROL BOARD PART 304 EFFLUENT STANDARDS SECTION 304.141 NPDES EFFLUENT STANDARDS
Section 304.141 NPDES Effluent Standards
a) No person to whom an NPDES Permit has been issued may discharge any contaminant in his effluent in excess of the standards and limitations for that contaminant which are set forth in his permit.
b) No person may discharge any pollutant subject to, or which contributes or threatens to cause a violation of, any applicable federal or state water quality standard, effluent standard, guideline or other limitation, promulgated pursuant to the CWA or the Act, unless limitation for such a pollutant has been set forth in an applicable NPDES Permit. However, the Agency may, by permit condition, provide that the permittee may discharge pollutants present in its water supply intake sources in concentrations not greater than the concentration in the intake sources, or which are added in trace amounts by normal domestic water usage.1
c) The standards of this Chapter shall apply to thermal discharges unless, after public notice and opportunity for public hearing, in accordance with Section 316 of the CWA and applicable federal regulations, the Administrator and the Board have determined that different standards shall apply to a particular thermal discharge.
