CHAPTER II: ILLINOIS EMERGENCY MANAGEMENT AGENCY SUBCHAPTER c: NUCLEAR FACILITY SAFETY PART 505 SAFE OPERATION OF NUCLEAR FACILITY BOILERS AND PRESSURE VESSELS SECTION 505.20 POLICY
Section 505.20 Policy
a) It is the intent of the Illinois Emergency Management Agency to implement this program in accordance with State law that provides that notwithstanding any other provision to the contrary, the Illinois Emergency Management Agency shall have sole jurisdiction over all boilers and pressure vessels contained within or upon or in connection with any nuclear facility within this State. The Illinois Emergency Management Agency shall have the same authority and shall have and exercise the same powers and duties in relation to those boilers and pressure vessels under the Boiler and Pressure Vessel Safety Act as the Board of Boiler and Pressure Vessel Rules or the State Fire Marshal have and exercise in relation to all boilers and pressure vessels in this State that are not included in this Section. b) This Part is intended to implement Sections 2a and 2b of the Boiler and Pressure Vessel Safety Act in a manner consistent with the State role provided for in the ASME Code and National Board Inspection Code. The Agency intends to review Inservice Inspection Plans, reports and other documentation, as provided in this Part, to determine, in coordination and cooperation with the NRC, compliance with the ASME Code, National Board Inspection Code and other applicable codes and standards incorporated by reference in Section 505.40 of this Part.
c) This Part is not intended to be, in any way, inconsistent with the applicable regulations, rules and requirements of the NRC. If a requirement of this Part as applied in any situation is or would be inconsistent with the regulations, rules and requirements of the NRC, the requirements of this Part shall not be applied. In addition, if the application of any requirement of this Part could affect the safety or the operation of the nuclear facility, as determined by the NRC, the Agency shall apply the requirements only with the prior concurrence of the NRC, as provided for in Section 505.86.
