SUBTITLE C: ECONOMIC DEVELOPMENT CHAPTER I: DEPARTMENT OF COMMERCE AND COMMUNITY AFFAIRS PART 530 ILLINOIS NETWORK OPPORTUNITY PROGRAM SECTION 530.20 PROCEDURES
Section 530.20 Procedures
a) Quarterly, the Department of Commerce and Community Affairs will compile, from information published or otherwise made available by the U. S. Patent Office, a list of all new patents, issued to Illinois' individuals and companies, as required under the Act. Concurrently, the Department will solicit from the University of Illinois, or assist the University in the preparations of, a list of all patents, granted as a result of university research, as required under the Act.
1) Such lists shall include, for each patent, its patent-class and subclass, a brief description of the invention for which the patent was granted, the name or names and addresses of the patent holder or holders, whether inventors or assignees, and the patent number and issue date.
2) The patents listed shall be patents included in the latest available U. S. Patent Office lists, to be used as sources for the purposes of the Act, covering a period of one calendar quarter.
b) Each quarter, when the compiled patent lists required by the Act are completed in the Department of Commerce and Community Affairs, and prior to their publication by the Department, the Department will mail to each patent-holder, as indicated in the U. S. Patent Office source lists, a request for consent to list the holder's patent and related information, as described in Section 530.20(a) of this Part, in the quarterly publication by the Department required under the Act. The mailing will notify that a period of 20 days is allowed for response to the Department.
c) Following the 20 days response period, the Department of Commerce and Community Affairs will prepare a revised quarterly patent list with related information as described in Section 530.20(a) of this Part. The list shall include only those patents whose holders have given their consent to publication by the Department by means of a returned response duly signed and returned to the Department within the allowed response period. This revised list shall be the list for quarterly publication.
d) Within 60 days after the response period, the Department of Commerce and Community Affairs will publicize the availability of the revised list in a prominent place in the Illinois Economic Report. The Department may also publicize the availability of the list through other media such as the Illinois Library system, association mailings, or news release. Such publicity shall include instructions for obtaining selected issues of the lists or subscribing for their quarterly receipt on a regular basis. The Department will supply the lists upon request, by mail or other appropriate means consistent with the Department's data processing capabilities, and will charge a fee of fifteen cents per page for the service only to offset the costs of publishing. |
