SECTION 576.420 RESPONSE TO APPEAL


 

Section 576.420  Response to Appeal

 

The Attorney General shall respond to an appeal in writing within seven working days of receiving notice thereof.  The Attorney General shall provide access to the requested public records or affirm the denial.  If an appeal is denied, the Attorney General shall set forth the reasons for denial, and shall inform the requestor of his or her right to judicial review of his or her request under Section 11 of the Freedom of Information Act.  Failure to respond to an appeal within seven working days may be considered by the requestor as an affirmation of the denial.  For purposes of this Section, action on an appeal by the Attorney General or the Deputy Attorney General shall be considered action by the Attorney General.
